Baby Born in Poland? Karta Pobytu for a Newborn Foreigner — PLN 340, One Deadline (2026)

Karta Pobytu for Newborn in Poland: PLN 340 (2026)

Baby born in Poland to foreign parents? Karta pobytu (residence permit) for a newborn: PLN 340, MOS filing, birth registration in 21 days. WhatsApp us.

Your daughter is nine days old. The hospital in Łódź sent you home with a tiny hat, a folder of papers and one question that keeps you awake at 3 a.m.: does she have any legal right to be here? Not yet — and that's fixable. A baby born in Poland to foreign parents isn't automatically a resident, and she isn't automatically Polish. She needs her own karta pobytu (Polish residence permit). This guide covers the karta pobytu for a newborn in Poland in the order you'll actually do things: birth registration, PESEL, passport, then the permit itself. The fee is PLN 340. There's one deadline that matters. And no, nobody is knocking on your door tomorrow.

So, does a baby born in Poland get a karta pobytu automatically?

No. Birth in Poland gives your child a Polish birth certificate (akt urodzenia) whatever your nationality — but a birth certificate is not a residence status. Your baby keeps a foreign nationality, normally the same as the parents' (your embassy can confirm the rules for your country). In Polish law she is a foreigner who needs a permit of her own.

The route the law gives you is a temporary residence permit for a child born while a parent holds a national visa or a temporary residence permit — Article 160 of the Act on Foreigners, as described on the MOS portal. The key point: the child's stay is legal only once that permit is granted, not from the day of birth. That's why you don't want to sit on this.

Two conditions decide whether this route works for you:

What do you do first — register the birth, get a PESEL or get a passport?

In this order. Each step unlocks the next one, and the first two are on a clock.

  1. Hospital birth card. The doctor or midwife who delivered the baby issues it and passes it to the registry office (USC). You don't file it yourself — just know it exists, because your 21-day clock starts from it.
  2. Register the birth at the USC within 21 days of the birth card being issued. Go in person or file online through obywatel.gov.pl. Miss the 21 days and the registrar will register the birth anyway — and choose the baby's first name for you. Not a story you want to tell the grandparents.
  3. PESEL. The registry office gives your baby a PESEL when at least one parent already has one. If neither of you has a PESEL yet, fix that first.
  4. Baby's passport. Apply at your embassy or consulate the same week you get the Polish birth certificate. Every country has its own waiting time, and this is usually the slowest step in the whole chain.
  5. Health insurance. Register the baby as a family member through your employer or insurer. Without it, the permit file is incomplete.
  6. The permit application itself, filed through MOS.

Child insurance rules sit with ZUS and NFZ. The fastest route is simple: ask your employer's payroll team to add the baby as a family member, then keep the confirmation. If you're already past the 21 days for registration, don't wait for the perfect file — go to the USC this week.

What is the deadline for a newborn's karta pobytu, and what does it cost?

Here is the rule as the official pages describe it: file as soon as you have the baby's travel document, and no later than the last day of your own legal stay in Poland. We didn't find a fixed number of days in the official text, so ignore any 'you have exactly X days' message from a WhatsApp group. The real deadline is the passport — and the passport is the slow part.

What it costs:

Filing runs through MOS (mos.cudzoziemcy.gov.pl). Under current rules, residence applications are submitted electronically and signed with a Trusted Profile (profil zaufany) or a qualified e-signature — confirm the details on gov.pl/cudzoziemcy before you start. The office can't issue a decision earlier than one month after your case begins, and in practice it takes longer. We explain realistic timing in How Long to Wait for a Karta Pobytu in 2026.

Which documents does the baby's permit application need?

The voivode's checklist is short, but every line has to be there. The official fee page for this permit and the voivode office pages list the same core items:

One small bonus: the birth certificate is a Polish document, so it needs no sworn translation. If anything else in your file is in another language, check before you file, not after.

Illustrative example: Sunil, a warehouse supervisor from Punjab, registered his son's birth in week one. The baby's passport took two months to arrive — and Sunil realised his own card expired in five. He filed the baby's permit the day the passport landed and booked his own renewal for the same week. Practical tip: write the expiry date of your own card on the front of the baby's folder, and start the passport application the day the Polish birth certificate is in your hands.

What happens to the baby's permit when your own card expires or changes?

They are tied together. The baby's permit is granted until the day your visa or permit expires. So when you renew, the baby needs to renew too — ideally in the same week, with the same set of income and housing papers.

Plan your own renewal early. Our Polish Residence Card Renewal 2026 guide explains the last-day filing rule, and Temporary Residence in Poland for Foreigners 2026 shows how the 3-year cap works. The baby's permit can never be longer than yours.

If your own status is shaky — a job ending, a pending refusal — the baby's case is shaky too, because the whole route depends on you being in Poland on the permit you held at birth. Talk to someone before that happens, not after. It's much easier to protect two files at once than to rescue one.

Frequently Asked Questions

Is my baby Polish because she was born in Poland?

No. Being born in Poland gives her a Polish birth certificate, not Polish citizenship. She normally holds the nationality of her parents, so legally she is a foreigner and needs a residence permit of her own. Your embassy can tell you how her nationality is recorded and how to get her passport.

How many days do I have to register a newborn in Poland?

21 days from the date the birth card is issued, at the registry office (USC) — in person or online via obywatel.gov.pl. After that the registrar registers the birth from the birth card and chooses the first name. The PESEL comes with the registration if at least one parent already has one.

How much does a karta pobytu for a newborn cost in 2026?

PLN 340 stamp duty for a child born during a parent's visa or temporary residence permit, according to the MOS portal. Add the baby's passport fee from your embassy and the photo. Check the MOS fee page on the day you file, in case the amount has changed.

Can I file the baby's permit before her passport arrives?

The official document list includes the child's travel document, so plan to have the passport first. That's why starting the passport the week after birth registration is the single best way to save time. If the embassy is slow and your own stay is ending soon, message us early.

What if my own permit expires before the baby's decision?

File your own renewal on time — it can't wait for the baby's case. The baby's permit follows yours, so both files need to line up. Tell us about both when you write, and we'll check the dates together.
