Temporary Residence in Poland for Foreigners 2026

Temporary residence in Poland for foreigners 2026: which Karta Pobytu fits you, PLN 340/440 fees, the last-day filing rule and MOS. Ask us on WhatsApp.

It's a Thursday evening. Your visa runs out in three weeks, your employer says "the papers are in progress," and a friend in the dorm swears you can just keep working while you wait. Another friend says the opposite. Who's right? Honestly, both are half right, and that's what makes temporary residence in Poland for foreigners so stressful. The rules are not complicated. They're just strict about one thing: timing. This guide walks you through what the permit is, which type fits you, what it costs in 2026, and the one deadline that decides everything.

So, what does temporary residence in Poland actually mean?

Temporary residence is the middle step between a visa and permanent status. You get a permit for a fixed period, and the plastic card that proves it is the Karta Pobytu (Polish residence permit). Poland issues a temporary permit for a maximum of three years at a time, and then you renew it or move on to a longer-term status.

Which temporary residence permit fits your situation?

There is no single "temporary residence" form for everybody. The office looks at why you're in Poland, and every purpose has its own paperwork. The common ones for workers and their families:

Bringing your wife, husband or children to join you is its own path. We explain who skips the long waiting period in Family Reunification in Poland 2026.

How much does a temporary residence permit cost in 2026?

The state fee depends on the type of permit. According to the voivodeship office fee tables, a temporary residence and work permit costs PLN 440, while the other temporary residence cases cost PLN 340. The fee has to be paid when you file, and an application without proof of payment gets returned. Check the current table at gov.pl/web/cudzoziemcy before you pay, because fees are set by regulation and can change.

Don't forget the costs around the fee. These are the ones that surprise people:

If a quote from anyone sounds far below these numbers, ask what is missing from it. A fee that looks cheap and then grows by half is a red flag, whoever is selling it.

What's the deadline, and what if you're late?

This is the rule that matters most. You must file your application no later than the last day of your legal stay: the last day of your visa, your visa-free period, or your current residence card. Not the week after. Not "as soon as HR sends the letter." The last day.

If you file in time, you can stay in Poland legally while the office decides. That's why you hear about "the stamp" in conversations in every dorm and workplace. If you file late, the stay in the meantime is no longer covered, and fixing it becomes much harder.

An illustrative example, not a real client: a care worker from Kathmandu whose employer kept postponing the paperwork. She stopped waiting, collected what she could herself, and filed six days before her visa ended. Her stay stayed covered while the office worked, and her employer's missing document was added afterwards when the office asked for it.

Notice what she did right: she filed on time even with an incomplete file. A formal gap can usually be fixed when the office asks. A missed date cannot.

Renewing an existing card? The same last-day logic applies. We cover the details in our renewal guide.

How do you file now that MOS is online-only?

Since 27 April 2026, applications for temporary residence, permanent residence and EU long-term resident status go through the electronic MOS portal. Paper applications that had not reached the office before that date are not considered. Official information is on the MOS portal and on the voivodeship websites such as uw.gov.pl.

The usual order of steps:

  1. Get the identity tools for MOS. UdSC guidance says you need a PESEL number and a trusted profile (profil zaufany). Sort these out first, because they take days, not minutes.
  2. Choose the permit type that matches your purpose, and gather the documents for that exact type.
  3. Pay the state fee and keep the proof.
  4. Fill in and submit the application in MOS, with attachments, before the last day of your legal stay.
  5. Attend the fingerprint and personal appearance step when the office invites you.
  6. Answer any request from the office within the deadline it gives you. Ignoring a letter is how good cases get left behind.

The same law applies in every voivodeship, but offices work at different speeds and ask for slightly different supporting papers. We compare them in Warsaw vs the Rest of Poland for Foreigners.

What if the answer is no, or nothing arrives?

Two different problems, two different tools.

Refused? An appeal generally has to be filed within 14 days of receiving the decision. Day one matters. Read Karta Pobytu Denied? 14 Days to Appeal before you do anything else.

Waiting too long? The law gives the voivode 60 days from a complete application, and real waiting times vary by office. If the deadline is clearly exceeded, you can file a complaint about the delay (ponaglenie). See what it does in 60 Days Passed, No Decision.

Practical tip: screenshot every MOS confirmation, save every PDF, and write the filing date on your phone calendar the day you submit. If anyone ever asks when you applied, that one record protects your stay.

Frequently Asked Questions

Can I keep working while my temporary residence application is pending?

It depends on your type of permit, your employer and your current status. Filing on time keeps your stay covered, but it does not automatically mean every kind of work is allowed. Send us your documents and your employer's details before you decide to keep working.

My employer says the application can wait. Can I file myself?

You can file your own application, but some supporting documents come from the employer. File before your legal stay ends and tell the employer in writing what you need. A missing paper can usually be supplied later when the office asks.

What if my visa expires before I get the card?

If you filed before the last day of your legal stay, your stay stays covered while the application is pending. The card is a document that follows later. Keep the MOS confirmation with you and don't leave Poland without checking the rules for your case.

How long can a temporary permit be valid?

A temporary residence permit is issued for a maximum of three years. The exact period depends on your documents, such as the length of your work contract. After that you renew it or look at a longer-term status.
