Friday: you’re at the USC (Urząd Stanu Cywilnego, the Polish civil registry office), the marriage certificate is in your hand, everybody’s hugging. Monday: a colleague slaps your shoulder — “So, your Karta Pobytu (Polish residence permit) is done, right?” No. A marriage certificate isn’t a residence card. It’s the paper you need to apply for a karta pobytu through marriage — and how you apply decides whether the next months are calm or a countdown to the end of your visa. Let’s go through what marriage to a Polish citizen really gives you in 2026, what it doesn’t, and the order to do things in.
What does marriage to a Polish citizen really give you? A card for up to 3 years
Marriage to a Polish citizen gives you the right to apply for a zezwolenie na pobyt czasowy — a temporary residence permit based on the marriage. It is granted for up to 3 years. For this ground, the voivodeship procedure page lists no requirement for a stable income, health insurance or proof of accommodation. The card carries an annotation for access to the labour market, so you can work without a separate work permit (see the page for spouses of Polish citizens).

What you need to know about the process:
- You apply online only. Since 27 April 2026, paper applications for temporary residence are no longer accepted — only through MOS (Moduł Obsługi Spraw, the online case system). You need a PESEL, a Profil Zaufany and an MOS account. What to set up first is in our Profil Zaufany vs mObywatel guide.
- You must file no later than the last day of your legal stay. This is the most important rule in this whole article — we’ll come back to it.
- If you file on time and the application has no formal gaps (or you fix them by the deadline), your stay is legal from the day of filing until the decision becomes final.
- The plastic card is issued separately and costs PLN 100. Check the permit fee itself in your voivodeship’s current fee table — amounts get updated, and an outdated sum on a payment slip costs time.
Getting married in Poland as a foreigner: USC, one month, PLN 84
A wedding in Poland doesn’t start with a restaurant. It starts with a declaration at the USC, filed together with your future spouse. Then one rule applies: you can marry no earlier than one month after filing. The stamp duty for drawing up the marriage record is PLN 84. If your Polish is weak, an interpreter must be present at the ceremony. Dates can be booked ahead — according to city office pages, up to six months in advance.
Exactly which documents from your home country the USC asks for depends on your citizenship. The logic is clear in our guide to marrying at a Polish USC with documents (written for Indian citizens, but the order of steps is similar) and in the article on how long it takes and what a court can do. One rule: first get the list from your own USC, then order translations and certificates.
One more thing: the waiting month is time too. If your visa or card is about to expire, count backwards from your last legal day — not forward from the date you’d like for the party.
What marriage does NOT give you: 4 things people learn too late
These are the places where people get caught — not by the law, but by their own expectations.
- Marriage doesn’t legalize an expired stay. You must file in MOS no later than your last legal day. A certificate received the day after your visa ended doesn’t roll anything back.
- Marriage doesn’t give permanent residence or citizenship “by stamp”. First comes the temporary card, then years in Poland and Polish at B1. Numbers are in the next section.
- Marriage doesn’t skip the check. The urząd looks at whether the marriage is real, and a sham marriage is not a hack — it has serious consequences. How they check is in our article on the real-marriage check.
- Marriage doesn’t make the card permanent, and it lives only as long as the marriage does. The permit is granted because of the marriage. If the relationship ends, the basis of your card changes — work through your position before filing for divorce, not after.
If you already have another karta pobytu case pending and marry in the middle of it, that’s a separate situation. The wedding doesn’t replace the pending case; we explain the order of steps in getting married while your karta pobytu is pending.
From karta pobytu to permanent residence and citizenship: 3 years married, 2 on a card, B1
The good news: marriage to a Polish citizen is one of the shortest routes to a permanent status. But “short” doesn’t mean “instant”. Here are the numbers confirmed on official pages.
- Permanent residence (zezwolenie na pobyt stały): married at least 3 years at the time of filing, and at least 2 years of continuous stay in Poland on a temporary permit granted because of the marriage. The fee is PLN 640 and the statutory decision time is 3 months from a complete application. File through MOS before your current card expires. The conditions are in our article on permanent residence for the spouse of a Polish citizen.
- Citizenship by recognition: at least 2 years of continuous stay on permanent residence (or EU long-term resident status), at least 3 years of marriage to a Polish citizen, and Polish at B1.
- What counts as “continuous”: no single break longer than 6 months, and all breaks together no longer than 10 months.
The routes to citizenship and their timelines are covered separately in the overview of all Polish citizenship routes.
An illustrative example, not a real client: Nodira, a seamstress from Tashkent, married a Pole nine days before her work visa ended. She received the certificate on Monday and filed in MOS on Tuesday, with all attachments and scans of her passport. Her stay became legal from the moment of filing, and she waited for the decision at work, not in fear of an inspection. Had she waited “a couple more days to get everything perfect”, she would have been filing in a completely different situation.
Practical tip: set three reminders on your phone — 60, 30 and 14 days before your visa or card ends. And choose the date of your USC declaration by your last legal day, not by the party: from that day count one month of waiting, a few days for documents, and the MOS filing.
What if you’re Ukrainian, or your spouse is also a foreigner?
For most countries the rules are identical: marriage to a Polish citizen is one ground for a temporary card, whether you come from Belarus, Moldova, Uzbekistan, the Caucasus or South Asia. The exception is citizens of Ukraine, who have a separate framework.
For Ukrainians with PESEL UKR the special act has been wound down, and stay is extended automatically until 4 March 2027. Since 4 May 2026 you can apply for the CUKR card (issued for 3 years), but only online in MOS and by 4 March 2027; you need UKR status on 4 June 2025, on the filing day, and continuously for at least 365 days. That is a separate route, not tied to marriage. If you are Ukrainian and married to a Polish citizen, you have a choice of routes, and which is better depends on dates and documents. Conditions are updated, so check the CUKR page in the MOS question base and the general gov.pl page for foreigners.
If your husband or wife is also a foreigner with a karta pobytu, that is a different procedure: family reunification, with its own conditions and deadlines. See our article on family reunification in Poland.
