It's the second week of April and Bikash, a warehouse operator from Pokhara, sends us a message: 'My friend says I must do PIT. My employer says the company does everything. I have karta pobytu. Who is right?'
Neither of them is fully right, and the gap between the two answers is where people lose money. A PIT tax return in Poland is the yearly report you file with the tax office (urząd skarbowy) about what you earned and how much tax was already taken. Having a karta pobytu (Polish residence permit) does not switch that duty on or off. Here is how it works for 2026: who has to file, how to do it for free, and what to do if April has already passed.
So, do you actually have to file a PIT tax return in Poland?
Short answer: if you earned money in Poland during the year, almost certainly yes. The karta pobytu itself is not the trigger. What matters is whether you had income taxed in Poland (a salary under umowa o pracę, a umowa zlecenie, a umowa o dzieło) and whether you count as a tax resident.
Poland treats you as a tax resident if one of two things is true:
- You spent more than 183 days in Poland in the calendar year, or
- Your 'centre of vital interests' is here: your family, your home, your job, your bank account, your loans.
Residents are taxed on income from everywhere. Non-residents are taxed only on what they earn in Poland, and some reliefs work differently. If you arrived in March or left in October, it is not always obvious which group you belong to. Ask before you file, not after.
On dates, because it is October 2026: the deadline for income earned in 2025 was 30 April 2026, and the Twój e-PIT service opened on 15 February 2026. Income you earn in 2026 goes into the next season, with the same standard deadline, which means 30 April 2027. Confirm the exact opening date on gov.pl/web/podatki in January.

Wait, doesn't my employer already take care of the tax?
Your employer does one part. Every month they withhold an advance on your income tax and pay it to the tax office. After the year ends they give you a PIT-11, a statement of what you earned and how much tax was already paid. For the 2025 tax year, employers had until 2 March 2026 to hand it over, because 28 February fell on a Saturday.
What they do not do is file your annual return. The PIT-11 is an information document. The return itself, usually PIT-37 for salary and zlecenie income, is yours to submit or at least to check. That is the gap hiding inside Bikash's question.
Two things to check before February:
- Your PESEL is on your contract and in payroll. Employers can no longer report income under placeholder numbers, and without a PESEL a correct PIT-11 cannot be issued. If you run your own business, a NIP can serve as the identifier, but that is a different situation.
- You receive one PIT-11 from every payer. Two employers in one year means two PIT-11s. Zlecenie with three clients means three. A missing one means a wrong return.
Not sure whether your contract counts as zlecenie or regular employment? Our guide on umowa zlecenie vs umowa o pracę explains the difference. It also affects how your income and contributions show up on paper.
How do I file it, step by step, for free?
Filing is free through the government's own service. Be careful with strangers or 'agents' in social media groups who offer to file for a fee and ask for your login details. Here is the do-it-yourself route:
- Collect every PIT-11 you received for the year and count them against your payers.
- Log in to Twój e-PIT in the e-Urząd Skarbowy on gov.pl, using Profil Zaufany or another login method offered there.
- Open the pre-filled PIT-37 and compare the income and tax figures with your PIT-11s, line by line.
- Fix or add anything missing: an employer who did not report, a relief you qualify for, a spouse if joint filing is open to you (check the conditions first).
- Accept and send. Save the confirmation (UPO) as a PDF.
- No digital login? You can submit a paper PIT-37 at the tax office. Just know the refund clock is slower, as explained below.
One more thing: if you do nothing, a PIT-37 prepared from your employers' data is accepted automatically on 30 April. That sounds convenient, but it contains only what employers reported. If you worked off-contract, or a payer reported late, the automatic version can be wrong, and a wrong return is still your return.
How much tax will I actually pay, and can I get money back?
For 2026 the general scale has two steps: 12% on income up to PLN 120,000 and 32% on the part above that. There is also a tax-free amount of PLN 30,000, which the formula builds in as a PLN 3,600 reduction (30,000 × 12%).
Run the numbers for a typical worker. The 2026 minimum wage is PLN 4,806 gross (see our minimum wage article, because the same figure matters for your karta pobytu). Twelve months at that level is PLN 57,672 gross, well inside the 12% band. The 32% step is not your problem.
A refund appears when the advances withheld during the year were higher than the tax you owe for the whole year. That is common if you worked only part of the year, changed employers or had gaps. For a return filed electronically, the tax office has 45 days to pay (counted from 16 February at the earliest); for a paper return, three months. We cannot promise an amount. Twój e-PIT calculates it the moment you open the return.
Illustrative example (a composite, not a real client): Dipak, a forklift operator from Nepal, changed employers in July and received two PIT-11s. Twój e-PIT combined both into one return and showed an overpayment, because the two employers' advances together exceeded the tax for the year. He checked every figure against the PIT-11s, accepted the return, and the refund arrived in his Polish bank account inside the 45-day window. No agent, no fee.
Practical tip: In January, make one folder on your phone with every contract, payslip and, in February or March, every PIT-11. If an office ever asks for proof of income, you will find it in two minutes.
I missed 30 April. Now what, and does PIT touch my karta pobytu?
You are not going to be deported tomorrow over a late PIT. But do not sit on it either. File the return as soon as you can, and if you owe tax, pay it with interest. If you filed nothing at all and owed tax, Polish law allows a 'czynny żal' (active remorse) notice to your tax office. It can protect you from a fiscal penalty, but only if the authorities have not already started proceedings, so talk to someone before you send anything.
If you were owed a refund, late is still better than never. Tax liabilities generally expire five years after the end of the year in which the payment was due, so older years can often still be fixed.
Now the card. We know of no fixed rule that says 'no PIT, no karta pobytu'. But the voivode's office can ask for documents confirming your income and the circumstances of your stay, and a filed PIT with its PIT-11 is the cleanest proof of a stable job. It sits next to the pay check in our salary threshold guide and your insurance proof in the health insurance guide. Lost your job mid-year? You will end up with more than one PIT-11, and a clock for notifying the urząd; see what to do after losing your job. For official procedures, start at gov.pl/web/cudzoziemcy.
