Umowa Zlecenie vs Umowa o Pracy for Karta Pobytu 2026: One Number, PLN 4,806, Decides

Umowa Zlecenie vs Umowa o Pracy 2026: Karta Pobytu

Umowa zlecenie vs umowa o pracy for karta pobytu 2026: both can work if pay reaches PLN 4,806 gross a month. See the risks, then ask us on WhatsApp.

Monday morning. Your manager slides the new contract across the desk: umowa zlecenie. You were hoping for umowa o pracę, the one everybody calls the 'proper' contract. Now you're staring at the page and wondering whether this will sink your karta pobytu (Polish residence permit).

Short answer, before you panic: no, not automatically. The umowa zlecenie vs umowa o pracy question reaches us from Bangladeshi workers almost every week, and the urząd doesn't grade a contract by its name. It looks at the pay, at the employer, and at what stands behind the paper. Here's how to read your own contract in ten minutes.

So, can you get a karta pobytu on umowa zlecenie at all?

Yes. A karta pobytu for work in 2026 means the zezwolenie na pobyt czasowy i pracę, one permit for living and working. The official MOS question-and-answer page is blunt about it: the minimum-pay requirement applies whatever your working hours are and whatever the legal basis is. That includes a civil-law contract like zlecenie.

So the office isn't really asking 'zlecenie or praca?' It asks three things. Is the pay at least PLN 4,806 gross a month, the 2026 minimum wage? Is there a real Polish employer who completed the employer form (Załącznik nr 1) online? And are insurance contributions actually going to ZUS? If the answers are yes, the permit can be granted for as long as needed, up to 3 years. The general rules sit on gov.pl/web/cudzoziemcy.

That's the whole game. Everything below is about making sure your contract passes those three questions, month after month, not only on the day you sign.

How does the PLN 4,806 rule work when zlecenie is paid per hour?

This is where zlecenie trips people up. On a zlecenie the law sets an hourly floor, PLN 31.40 gross in 2026, not a monthly one. But your permit file is judged on a monthly number: PLN 4,806 gross, even if you work part-time.

Do the maths. 4,806 divided by 31.40 is 153.06 hours. At exactly the minimum rate, 153 hours pays PLN 4,804.20, which is PLN 1.80 short. You need 154 hours in the month, every month, or a rate above the minimum.

Umowa o pracę: what do you get that zlecenie doesn't?

An employment contract (umowa o pracę) sits under the Labour Code. That means paid annual leave, notice periods and a layer of protection if the employer wants to part ways. Zlecenie sits under the Civil Code. It has none of that by default. It's a contract for a service, and it can be shorter, looser and easier to end.

Insurance is the second difference. If zlecenie is your only basis for insurance, contributions for pension, disability and accident insurance, plus health insurance, are mandatory. Sickness insurance is voluntary, and you have to ask for it. The rules are published by ZUS. Why does this matter for your permit? Because a clean contribution trail shows the authorities that your work is legal and your income is real.

So check your payslip each month. Do you see contributions listed? Does the number of hours match what you actually worked? If not, ask now, not at renewal.

Which contract is safer? A straight answer in four lines

Neither contract is 'safe' by name. Safe means the paper, the pay and the ZUS trail all line up. Here's how we'd rank what we see:

  1. Umowa o pracę, full-time, pay at or above PLN 4,806 gross. The simplest file and the most stable life.
  2. Zlecenie with guaranteed monthly hours that clear PLN 4,806, and full contributions. It works, but needs discipline from you and your employer.
  3. Zlecenie with 'flexible' hours and no minimum. The most common trap: the file looks fine in a good month and fails in a slow one.
  4. Anything partly paid in cash, or no ZUS at all. Red flag. Stop and ask before you sign or file. Umowa o dzieło usually produces no ZUS contributions, so it leaves a thin trail. Don't rely on it for a permit without checking.

Here is an illustrative example, a composite and not a real client. Rahim, a warehouse operator from Dhaka, had a zlecenie for 'around 140 hours'. In a slow month he was paid for 118 hours: 118 times 31.40 is PLN 3,705.20, well under the line. His employer agreed to rewrite the contract with fixed monthly hours and a higher rate, and his next filing was clean.

Reading the contract line by line before signing: rate, hours, ZUS
Reading the contract line by line before signing: rate, hours, ZUS
Practical tip: before you sign, find three lines: the rate per hour, the guaranteed hours per month, and the words about ZUS contributions. Multiply the first two. If the result is under PLN 4,806, ask for a change now. It's far easier than explaining a low month at renewal.

What if you change employer, or the zlecenie ends mid-process?

Contracts end. Employers change. That's normal, but the clock matters. A new employer means new paperwork, and there are deadlines. We explain them in Foreigner Changing Employer in Poland: 15 Working Days, What the Company Must Do (2026). If your application is still pending, read Changing Employer While Karta Pobytu Is Pending: 3 Steps, 1 New Document (2026) before you quit anything.

Money and format, so you can plan: the state fee is PLN 440 for the permit and PLN 100 for the card. Since 27 April 2026, applications go through MOS only, with no paper filing. Our TRC Process in Poland 2026 guide covers the steps, and the 9-document checklist for work permits shows what to collect first.

One more thing. You're not going to lose your status tomorrow because a contract is called zlecenie. But a weak contract can quietly make your next filing harder. Fix the paper while you still have time.

Frequently asked questions

If my employer switches me from umowa o pracę to zlecenie, do I lose my karta pobytu?

Not automatically. But your permit was granted on specific conditions, and a change of contract type or pay can matter. Don't sign anything new until someone has compared it with your permit and your last filing. Send us the draft on WhatsApp before you sign.

Is the PLN 4,806 gross or net?

Gross, meaning before tax and contributions. Your take-home will be lower. The urząd compares the gross pay on the contract and the payslips with the 2026 minimum wage, so make sure your payslip shows the gross figure.

Can I do zlecenie for two companies and add the pay together?

Published guidance says income from several employers is added up for the pay check. But your permit names a specific employer and conditions, so extra work elsewhere may not be covered. Check before you start a second job.

Does umowa o dzieło work for a karta pobytu?

Be careful. Dzieło is for a specific result, and it usually doesn't create ZUS contributions, so it leaves a thin trail. We wouldn't rely on it as your only contract for a work permit. Ask us first.
