The envelope from the urząd wojewódzki is thicker than you expected. Inside is a decyzja, and one word jumps out: odmowa. Refusal. Your stomach drops. That permit was supposed to make the last year of work in Warsaw count. If your karta pobytu was refused, nobody is knocking on your door tonight. But a clock has started. Under Polish procedure you normally have 14 days from the day you receive the decision to appeal. This guide is written for Kenyan applicants, and for anyone in the same position. It covers what to do on day one, what a refusal costs, and what not to do. Read it once, then act.
What does 'refused' really mean, and when does the 14-day clock start?
A refusal is a written decision (decyzja) from the voivode, the regional head of the office. The 14 days count from the day you receive it, not from the date printed at the top. Keep the envelope, the delivery slip and any tracking message. According to the Poznań voivodeship office's official FAQ, if you miss the deadline the decision becomes final. If you then have no other legal basis to stay in Poland, you are obliged to leave within 30 days. That is why 'I will sort it out next month' is the most expensive sentence in this whole process.

Before anything else, read the letter slowly. It has three parts, and each one answers a different question. We break the structure down in our guide to reading a Polish decision letter. In short:
- The ruling (sentencja): the short line that says the permit is refused.
- The reasons (uzasadnienie): the part that matters most. It names the requirement the office says you did not meet.
- The instruction on appeal (pouczenie): who can review the decision, how, and by when.
How do you file the appeal (odwołanie) inside 14 days?
You do not need a perfect legal essay on day one. You need a valid, signed appeal that arrives on time, plus the documents that answer the office's reasons. Here is the order that works.
- Write down the date you received the decision and photograph the envelope. This proves you filed inside the window.
- Find the exact reason for refusal in the uzasadnienie: salary, contract, insurance, address, a missing paper, or something else.
- Write a short odwołanie: your name, case number, the date of the decision, and a clear statement that you appeal against it.
- Attach the documents that fix the problem. The office accepts missing documents together with the appeal.
- Sign it and send it. The Poznań office lists three routes: Polish Post (the posting date counts), the office's submission point, or ePUAP.
What happens next depends on the file. According to the same official FAQ, if the appeal is valid, filed on time, has no formal defects such as a missing signature, and the missing documents are complete, the voivode can issue a new decision within 7 days. If there are doubts or the papers are incomplete, the case goes to the second instance, the Head of the Office for Foreigners in Warsaw. General information for foreigners is on gov.pl/web/cudzoziemcy.
An illustrative example, not a real client: Achieng, a care worker from Kisumu, received a refusal because the salary on her payslips did not match the figure in her employer's contract papers. She did not panic-call the employer for a week. On day four she photographed the letter, collected corrected payslips and an updated employer statement, and posted the appeal with proof of posting on day nine. The file went back to the officer with the missing piece attached, which is exactly what an appeal is for.
Why do karta pobytu applications get refused, and can the reason be fixed?
Every refusal has a reason on paper. Some can be repaired with documents. Others need a new strategy. These are the categories we see most often in refusal letters:
- Income and contract problems. The 2026 minimum wage is PLN 4,806 gross, and many cases turn on how pay is documented. See why salary-threshold cases fail.
- Health insurance that does not meet the rule. Compare the options in our ZUS versus private policy guide.
- Proof of where you live that is missing, out of date or unclear.
- A change of job or a lost job while the case was open. Read what the 15-working-day rule means.
- For family-based applications, doubts about the relationship. A spouse's refusal follows a similar clock, covered in this appeal guide for spouses.
The test is simple. If the missing element exists in real life, you can usually prove it. If it does not exist, an appeal alone will not create it, and you need a different plan.
What does a refusal cost, and should you appeal or apply again?
Fees matter here. Official voivodeship fee tables list PLN 440 for a temporary residence permit combined with work, PLN 340 for a standard temporary residence permit, and PLN 100 for issuing the card itself. There is a 2026 change you should know about: according to a report on the new rules, for applications submitted from 5 March 2026 the paid fee is not refunded if the office refuses or discontinues the case. A rushed second application can therefore mean paying again for a file with the same weakness.
So the question is not 'appeal or reapply?' in the abstract. It is whether the reason can be fixed with papers you already have or can obtain within 14 days. If yes, an appeal is the natural route. If the decision came after a long delay and you are now stuck waiting again, read how a ponaglenie works. And if you are not sure which route fits, send us the letter before the deadline, not after.
Which mistakes turn a refusal into a bigger problem?
- Waiting for the employer to 'handle it'. The deadline is yours, and the employer's HR may not know the decision exists.
- Counting from the date on the letter instead of the date you received it, or the opposite, without proof of either.
- Sending an angry letter with no documents. An appeal that only says 'this is unfair' leaves the missing piece missing.
- Posting by ordinary mail without a receipt. Keep the proof of posting; the posting date is what counts.
- Leaving Poland or switching jobs in a panic before anyone has checked what it does to your case.
Practical tip: on the day the letter arrives, photograph every page and the envelope, write the receipt date on a sticky note on the first page, and set a phone alarm for day 10. Day 10 is your real deadline, because it leaves four days for mistakes.
