Karta Pobytu Waiting Too Long? Ponaglenie 2026

Karta pobytu waiting too long? Learn what a ponaglenie does, the 60-day rule, the PLN 100 court step, and when to act. Message us on WhatsApp for a file check.

Five months ago you submitted your karta pobytu application. Since then you've checked MOS every morning. You've called the urząd twice and got a recorded message. Your employer keeps asking, "Any news?" And you're sitting in a flat in Wrocław, a Nigerian citizen with a job, a contract and a legal stay, wondering if something is wrong with your file. Usually, nothing is wrong. The office is just slow. But Polish law gives you a specific tool for this exact situation: the ponaglenie, a formal reminder to the higher authority. If you are waiting too long for a karta pobytu decision in Poland in 2026, this is what it does, what it doesn't do, and when to use it.

How long is "too long" for a karta pobytu decision?

The Act on Foreigners gives the voivode, the urząd wojewódzki, 60 days to decide a temporary residence application (Article 112a). The count runs from the day the last of the formal starting events happened, not from the day you first thought about applying. Since 27 April 2026 applications go through MOS only, and you can see the main rules on the official gov.pl foreigners portal.

In real life, many offices run past that number. The office may ask for more documents, or check your employer, or simply have a pile of files on the desk. If the office sends you a request for missing papers, the time spent waiting for your answer generally does not count against the office. Our post on the wezwanie letter and the 7-day deadline explains why you must never ignore that letter.

When the office is late with no good reason, Polish law has names for it: bezczynność (the office does nothing) or przewlekłość (the office drags the case on). Being late does not mean refusal. It does not mean approval either. It means you have the right to push.

So what does a ponaglenie actually do?

A ponaglenie is a short written complaint that the office has not decided your case on time. It is based on Article 37 of the Code of Administrative Procedure. Think of it as telling the boss of the office: "My case is overdue. Please deal with it."

For residence cases the higher authority is the Head of the Office for Foreigners (Szef Urzędu do Spraw Cudzoziemców). You normally hand the letter to the voivode's office that is running your case, and it goes upward from there. The law gives the higher authority 7 days to look at it once it arrives. Voivode offices are listed at uw.gov.pl if you need the right address.

What a ponaglenie can do:

What it cannot do:

A ponaglenie is a short letter, but it must be precise: case number, dates and what you ask for.

What goes into a ponaglenie letter?

It does not need to be long. One page is enough. But it must be correct, because this letter is also your proof later if you ever go to court.

  1. Your details: full name, address in Poland, date of birth, and the case number from the office.
  2. The date you filed your application and the date from which the 60-day period started to run.
  3. A clear statement that the deadline has passed and no decision has been issued.
  4. The request: that the higher authority finds the delay unjustified, sets a deadline, and addresses whether it was a gross violation of law.
  5. Your signature and attachments: a copy of the filing confirmation and any correspondence.

Write it in Polish. Send it in a way that leaves proof, either through the electronic channel the office accepts or by registered post. If you are unsure which electronic channel works for you, read our guide to e-Doręczenia and MOS first. Keep the confirmation. Always.

Here is an illustration, not a real client. Emeka, a CNC operator from Nigeria working near Poznań, had waited seven months with only silence. His file was complete, so there was no reason for the delay. We prepared the ponaglenie and he sent it with proof. The office issued a decision after the reminder. A reminder does not work this way every time, and no honest advisor can promise it. But a complete file plus a correct ponaglenie is the strongest position you can be in.

Keep every confirmation of filing together with your ponaglenie. This folder is your proof if the case goes further.

What if the ponaglenie changes nothing: the court step

If the higher authority does not help, or the office stays silent, the next step is a complaint about inactivity (skarga na bezczynność) to the Voivodeship Administrative Court (WSA). Here is the key rule: the court expects proof that you filed a ponaglenie first. Courts in 2026 regularly ask applicants to show it within 7 days, so a skipped ponaglenie can sink an otherwise strong complaint.

The court fee for this complaint is PLN 100, a fixed fee. If you do not pay it after the court asks, the complaint is rejected. The court can then oblige the office to decide within a deadline. It does not decide your residence permit for the office, and it does not guarantee a positive answer.

We are an advisory and support firm, not a law firm of advocates. For representation in court you need an adwokat or radca prawny. What we do is prepare your documents, check the dates and deadlines, and help you not lose weeks. If a decision finally arrives, our guide on how to read a Polish decision letter (decyzja) shows what to check in the first 14 days.

Can I stay and work while my file sits there?

This is the fear behind every other question. If you submitted your application while your previous stay or permit was still valid, your stay is generally treated as lawful while the case is pending. The key word is "generally". The details depend on your situation, such as what you applied for and when.

Since the old passport stamp was replaced, people ask what proves their status. We cover it step by step in Passport stamp during karta pobytu: what it allows in 2026. Before you travel outside Poland during a pending case, check this first. Don't guess.

Practical tip: Before you send a ponaglenie, write down three dates on one page: the day you filed, the day the last formal step was done (for example fingerprints), and the day 60 days ended. Then attach proof of each. A letter with clear dates is read in minutes; a letter without them goes to the bottom of the pile.

Frequently asked questions

Will a ponaglenie make the office angry and hurt my karta pobytu case?

No. A ponaglenie is a lawful, ordinary step set out in the Code of Administrative Procedure. Offices receive them regularly. It does not change how your application is assessed. What matters for the decision is your file: contract, income, accommodation and correct documents.

I'm a Nigerian citizen. Do I have different deadlines from other nationalities?

No. The 60-day rule and the ponaglenie procedure are the same for every nationality in the same type of case. Nationality does not give you a longer or shorter deadline. What changes the timeline is the type of permit, the completeness of the file and the workload of your voivode's office.

Do I pay a fee to file a ponaglenie?

Check the current rules for your case on the official foreigners portal before you send it. What we can confirm is that the later court complaint about inactivity carries a fixed court fee of PLN 100. Filing and posting costs, such as registered mail, are on you.

How long should I wait before sending it?

Wait until the 60 days really have passed and you have checked that no wezwanie is hanging in your mailbox or on your account. If the office is still waiting for your documents, answer first. If the office is late and everything is complete, send the ponaglenie.
