The postman leaves a notice. Two days later you are holding a letter in Polish that says your spouse's Karta Pobytu (Polish residence permit) application has been refused. Your husband reads it at the kitchen table: formal language, article numbers, a paragraph that ends with the word „odmawia”. The first question is always the same: is this the end? No. But the clock has started. From the day the decision is delivered, you have 14 days to appeal. This guide explains what a Karta Pobytu refusal for a spouse means, how to write the appeal, what the office looks for in a marriage and what a Polish partner can do to help.
Karta Pobytu refused for a spouse: what exactly did the letter say?
A Karta Pobytu for the spouse of a Polish citizen is a temporary residence permit for a family member. It is granted for the period needed to reach the purpose of the stay, up to 3 years, and you can apply for further permits afterwards. In the first instance the decision is made by the voivode (wojewoda), so the refusal comes from the voivodeship office, not from the Office for Foreigners.
Every decision has three parts: the ruling itself (the refusal), the reasoning (why) and the instruction on how to appeal. The reasoning is the part that matters, because it shows what the office considered a problem. If you want to read such a letter line by line, our guide „How to Read a Polish Decision Letter” will help.

How to appeal a Karta Pobytu refusal: 14 days, step by step
The rules are simple, and there is no room for being late. The appeal is made in writing to the Head of the Office for Foreigners, but it is filed through the voivode who issued the decision. The deadline is 14 days from the day the decision was delivered, not the date printed on it. This is how the Poznań voivodeship office and the MOS portal describe it. Here is the order we recommend:
- Find the delivery date. Check the return receipt or the notice in MOS. Count 14 days from that date, write the last day in your calendar and set a reminder with a safety margin.
- Read the reasoning and list every ground for refusal. Each ground is a separate allegation that you need to rebut or explain. Mark what the office says was not proven and what it found untrue.
- Collect evidence. You need documents that show your relationship is genuine and that you live together – more on that below. If something is missing, do not wait until the last day: you can file the appeal on time and say that the missing proof will follow.
- Write the appeal. It must be in writing, signed, and clearly say that you disagree with the decision and why. It does not have to read like a court judgment, but it must answer the points in the reasoning.
- File it on time and keep proof. A postal receipt or an office stamp is your protection if anyone disputes the deadline.
- Do not sit and wait. During the procedure the office may ask for extra documents or call you to give statements. Answer within the deadline in the letter.
What the office looks for in a marriage – and what to show in your appeal
Let us say this plainly: the office must check whether a marriage was concluded to get around the rules on entry and stay for foreigners. If it was, a refusal is mandatory. That is why the authority can ask both spouses for extra documents or for statements about why and how the marriage was concluded. A marriage concluded only to get a permit leads to refusal and can have further legal consequences. We only help real couples, and that is how it should be.
If your relationship is real and the office did not see it, the appeal is your moment to prove it. Evidence from different sources and different periods works best:
- a rental contract or ownership papers, plus bills and letters from banks and offices addressed to your shared address;
- photos from several years, with family and friends, from trips and celebrations – not just one wedding photo;
- messages and call history from before the wedding, not only from the last few weeks;
- tickets, bookings and confirmations of joint trips;
- written statements from witnesses who know you as a couple, with their details so the office can hear them;
- shared commitments: a bank account, insurance, financial plans, a child's medical records if you have a child.
A word about interviews. Spouses are often questioned separately about everyday details and how they met. Do not memorise answers – just tell the truth, in detail. You will find more on how the office tests a marriage in „Marrying a Polish Citizen: the Real-Marriage Check”, and the whole application process is in our guide to a Karta Pobytu for a foreign wife – the same logic applies for husbands.
An illustrative example (made-up people, based on typical cases): Anna, a teacher from Poznań, and her husband Rohit, a chef from India, received a refusal after an interview in which the office found their answers inconsistent. In the appeal they attached a rental contract, bills, photos from several years and statements from two witnesses, and explained the differences in their answers. The second-instance authority set the decision aside and sent the case back for reconsideration. Every case is different and this result is not guaranteed – but complete evidence gives you a real chance.
Can your husband stay in Poland while the appeal is pending?
This is the question we hear most. The rule: if the application for a temporary residence permit was filed on time and without formal defects (or the defects were fixed within the set deadline), the foreigner's stay is legal from the filing date until the decision becomes final. The MOS portal and the Act on Foreigners say this. One exception: the rule does not apply if the procedure was suspended at the party's request. Whether your application was filed on time has to be checked in your documents, not guessed.
If the Head of the Office for Foreigners upholds the refusal and the foreigner has no other basis to stay, he should leave Poland within 30 days of that decision being delivered. A complaint to the Voivodeship Administrative Court in Warsaw is still possible within 30 days of delivery, filed through the Head of the Office for Foreigners. That is a stage that needs experience in drafting a complaint, so do not leave the decision to get help until the last minute.
And if a case drags on far longer than normal, there is a separate tool against inaction – we explain it in „Waiting Too Long for a Karta Pobytu Decision? What a Ponaglenie Does”.
Marrying a foreigner in Poland: why it feels impossible – and the real way through
You may have heard a friend say: „We want to marry too, but it seems impossible.” The typical situation is this: the partner is already in Poland, waiting for a Karta Pobytu (a stamp in the passport, the visa long expired) and cannot travel to his home country. The civil registry office (USC) asks for documents from his country – usually a certificate of legal capacity to marry, confirming that nothing prevents the marriage. The consulate either does not issue it or takes months.
There is a way out. Polish law on civil status records allows a court to exempt a foreigner from presenting that certificate – for example when his country does not issue it. Add sworn translations and the standard waiting period for a civil wedding: one month from filing the documents (30 days; in justified cases it can be shortened). So the honest answer is that the law requires several documents – and we collect and prepare them for you.
At Legal Solutions we organise the official registration of marriage at a Polish civil registry office and finish with a Polish marriage certificate (odpis aktu małżeństwa). To start, we only need passport details; we prepare the documents, obtain the required certificates and translations, run the procedure and accompany the couple at every stage. More on timing and what a court can do is in „Marrying a Foreigner in Poland: How Long It Takes and What a Court Can Do”.
One more thing: marriage is not a shortcut to residence. Offices check whether a marriage is genuine, and a marriage concluded only to get a permit leads to refusal and legal consequences. A wedding changes your family status and opens the way to apply for a Karta Pobytu as a spouse – it does not guarantee a positive decision.
Practical tip: scan or photograph the whole decision and the proof of its delivery the same day. Only then start collecting evidence – the delivery date is the one number the rest depends on.
