Tuesday, 8:15 a.m. You open your inbox and there's a letter from the voivodeship office. Not a decision. A summons: the officer wants more documents and explanations about your marriage. Your first thought: "Don't they believe us?" The second: "What do I say?"
Breathe. The marriage check by the voivodeship office in Poland is built into the Karta Pobytu (Polish residence permit) procedure for spouses of Polish citizens. It isn't an accusation. It's a check. Below we explain what the office verifies in 2026, what you can expect, and how to prepare, so you and your partner stay calm.
What does the voivodeship office actually check in a spouse application?
When you apply for a temporary residence permit as the spouse of a Polish citizen, the voivode doesn't only look at whether your documents are complete. According to voivodeship office guidance (Lubuskie, Wielkopolskie), the authority also establishes whether the marriage was concluded to circumvent the rules on entry and stay of foreigners in Poland. For that purpose it may summon you to provide additional documents or to give testimony about the circumstances and purpose of the marriage.
So the marriage certificate is only the starting point. The office wants to see that a real relationship stands behind the signature at the registry office.

Does marriage give you a Karta Pobytu? What it changes and what it doesn't
Not automatically. Marriage opens a family route, but the voivode still decides after checking your case. Here is what official sources say:
- A temporary residence permit is granted for up to 3 years. For a spouse of a Polish citizen, a stable and regular income, health insurance and secured accommodation are not required (powroty.gov.pl). That is a real relief compared with other residence grounds.
- Since 27 April 2026, temporary residence applications are filed only electronically through the MOS portal. An application filed any other way is left without examination.
- You must file no later than the last day of your legal stay in Poland. A wedding does not extend an expired visa or stay.
- Permanent residence is a separate path: at least 3 years from the marriage and at least 2 years of continuous stay on a temporary permit granted in connection with the marriage.
We cover what a wedding gives and doesn't give in Karta Pobytu Through Marriage 2026, and the permanent route in Permanent Residence for Spouse of a Polish Citizen 2026. Always check your decision letter for work rights, because official pages describe this point differently.
What if you get a summons: which documents and explanations should you prepare?
Offices don't publish a list of questions, so nobody can tell you in advance how your case will go. What counts is the letter itself: which documents, in what form and by what date. Below are examples of what usually helps show that a relationship is genuine. This is practice, not an official requirements list:
- proof of living together: rental contract, registration, bills in both names;
- photos from different periods, not only from the wedding;
- messages, call history, tickets and bookings for trips together;
- documents about shared matters: insurance, bank account, commitments.
If the office asks for explanations, tell the truth and tell it consistently. Don't memorise answers. Two people who really live together can easily describe their daily life. Don't hide awkward facts such as an age gap or a short courtship. It's better to explain them calmly than to leave the officer room for guesses.
Watch the deadline in the letter. If you can't deliver something in time, write to the office and give the reason. Silence is the worst reply.
Illustrative example (composite characters, not our clients): Rahul, a cook from Punjab, married his Polish wife Agnieszka in a registry office. Three months after filing, a summons asked for additional documents. They gathered a rental contract, bills, two years of photos and answered the office's questions. The case moved on because everything they submitted was consistent.
Practical tip: start collecting proof of your shared life from day one, not after the summons. A screenshot of a bill, a ticket, a dated photo. After a year you have a whole folder instead of three days of panic before the deadline.
And if you receive a refusal? You can appeal the voivode's decision, and the deadline is 14 days. We explain day one in Karta Pobytu Refused for a Spouse? The Appeal Clock Is 14 Days.
Why can marrying in Poland feel impossible before any marriage check even starts?
We see this every week. You are already in Poland. You are waiting for your Karta Pobytu, there's a stamp in your passport or your visa has expired, so you can't travel home. You want to marry, and the registry office (USC) asks for a document from your country. Your consulate doesn't issue it, or takes months. It starts to feel like marrying in Poland as a foreigner simply can't be done.
The law does require several things. Under the Polish Civil Status Records Act, a foreigner submits a document stating that, under the applicable law, they may marry, unless the ability to marry is assessed under Polish law. An identity document such as a passport, and the certificate, must be translated by a sworn translator. The certificate can be issued by your embassy or the competent authority of your country. On top of that, some registry offices refuse certificates that lack the other partner's details, although the Polish Ombudsman points out that the rules don't say so explicitly. The Ministry of the Interior took up the issue and in February 2025 sent a letter to the civil affairs departments of the voivodeship offices.
There is a legal way out. A district court can, on the foreigner's application, exempt them from presenting the certificate, among other cases when their country doesn't issue such documents or when, for political reasons, they fear approaching their own authorities (see the Ministry of Justice service card). Another element is the one-month waiting period before the wedding. The head of the USC can shorten it in justified cases. Details are in Marriage in Poland: One Month Waiting Period.
What do we do, and what can you and your Polish partner do?
Legal Solutions organizes the official registration of marriage for foreigners at a Polish civil registry office (Urząd Stanu Cywilnego). The result is a Polish marriage certificate (odpis aktu małżeństwa). The law requires several documents, but you don't have to chase them one by one. To start, we only need your passport details. We prepare the rest: documents, certificates, sworn translations, and the organisation of the whole procedure, and we accompany you at every stage. We don't promise timelines, because they depend on the offices and the court.
What can you do yourselves? A few things that really help:
- Gather your passport details and check how long your legal stay lasts.
- Ask your local USC which documents it requires from a foreigner. In practice, requirements differ between offices.
- If your country doesn't issue the certificate or your consulate is slow, don't wait for months. Ask about the district court route.
- After the wedding, order the marriage certificate and start collecting proof of your shared life right away.
- File the temporary residence application in MOS before your legal stay ends.
Sham marriages: the line we don't cross
We'll say it plainly. A marriage concluded only to obtain a residence permit leads to a refusal and legal consequences. Offices check this in every case, as described above. We only help genuine couples, people who love each other and want to build a life in Poland. If that's you, you have nothing to fear, and a well-prepared case shows it best.
A real marriage deserves a well-prepared case, and you don't have to go through it alone. Legal Solutions — 98% approval rate. Drop us a WhatsApp at +48 735 248 525 — we read every message.
