You open your banking app on the 12th. You're expecting PLN 800 per child from ZUS, the same amount that has landed every month since your family moved to Poland. This month: nothing. No letter, no SMS, just a gap where the money used to be.
If that sounds familiar, or you're afraid it soon will, this is for you. The 800 plus benefit 2026 for foreigners works differently from before. Since 1 June 2026, living in Poland legally with a Karta Pobytu (Polish residence permit) that allows work is no longer enough. ZUS now checks every month whether you actually work, whether your child actually lives here, and whether your child actually studies here. Let's walk through which families still qualify, and what to do if you're about to slip.
So what actually changed on 1 June 2026?
Two dates matter. From 1 February 2026, a work condition started applying to Ukrainian citizens with UKR status. From 1 June 2026, the same logic reached other third-country nationals: people from outside the EU, EFTA and the UK withdrawal-agreement group who stay in Poland legally and have access to the labour market. That's where most Indian, Nepali, Filipino and Bangladeshi families sit.

Before June, the question was basically: do you have legal stay and the right to work? If yes, you filed and the money came. Now ZUS looks one month back every time. According to ZUS, whether you're entitled for a given month depends on whether you were professionally active in Poland in the previous month. ZUS reads that from its insurance registers, in most cases without asking you for extra papers. The official summary sits on zus.pl.
Polish families, EU and EFTA citizens, and British citizens covered by the withdrawal agreement keep the old rules. For everyone else, ZUS also checks the child's situation. Which brings us to the three tests.
Which Indian families still qualify? Three tests, every month
Think of 800+ as a door with three locks. All three have to be open in the same month.
- Work. The parent who applies must be professionally active in Poland. In practice that means registered with ZUS for pension and disability insurance. Civil-law contracts like umowa zlecenie are included in the check, but only if contributions are really being paid.
- Residence. You and your child must live in Poland through the benefit period. ZUS reads Border Guard data, and an exit with no recorded re-entry is one of the most common reasons payments get frozen.
- School. The child must fulfil the preschool-preparation, school or learning obligation in a Polish institution. ZUS describes this condition as not applying to children under six.
To apply, you show a document proving legal stay: a karta pobytu with the annotation giving access to the labour market, or a permanent residence card. General residence rules are collected at gov.pl/web/cudzoziemcy.
Whether your contract holds up on the first test is the same question your karta pobytu asks. We cover it in Minimum Wage in Poland 2026: PLN 4,806 Gross — Does Your Pay Pass the Karta Pobytu Check? A contract that looks shaky for your permit deserves a second look for 800+ too.
Here's a ten-minute self-check once a month. Did you work last month, and is ZUS being paid for it? Did anyone in the family leave Poland without a recorded return? Is your child enrolled and attending a Polish school or preschool where required? Three yeses and you're in good shape. One maybe, and it's worth fixing before the next payment date.
What if only one parent works, or the contract is a zlecenie?
This is where many families get a surprise.
In ZUS's wording, the work condition follows the person who files the application. Picture a household where one spouse works and the other holds a family-member karta pobytu and stays home with the kids. The working spouse is the one who should file. A non-working applicant can fail the test even when the household is fully insured. If you're not sure who should apply, ask before you submit, not after.
Umowa zlecenie is not banned from 800+. It's treated as work that gets checked. What ZUS wants to see is registration in its systems and contributions actually paid. A zlecenie with a gap in contributions, or a contract that was signed but never reported, can show up as "not active". We compare the two contract types in Umowa Zlecenie vs Umowa o Pracy for Karta Pobytu 2026.
An illustration (composite, not a real client): Ravi, a warehouse supervisor from Pune, had two school-age children in Łódź and a stable employment contract. His payment froze after the family spent most of August in India. The Border Guard record showed the exit, but the return hadn't been matched. Ravi sent ZUS the boarding passes and a school confirmation, and the payments restarted.
If your spouse and kids are still in India, remember the residence test: the child has to live here. Our guide to Family Reunification in Poland 2026 walks through bringing them over. Applying for 800+ makes sense once the children have arrived and are enrolled.
Why did ZUS stop my 800+ payment, and how do you get it back?
A frozen payment isn't a final refusal. It means ZUS couldn't confirm one of the three tests in its registers. To restart it, ZUS has to receive explanations and evidence from you.
ZUS itself lists the most common reasons on its page about conditions for foreigners and possible reasons for suspension:
- The Border Guard register shows an exit from Poland by you or your child, with no data on re-entry.
- ZUS and the farmers' insurance fund (KRUS) have no record that you're registered for pension and disability insurance.
- The education information system has no record that your child is fulfilling the school or preschool obligation.
Lost your job? A month without work means no payment for the month after it. What to do with your permit at that moment is in Karta Pobytu After Losing Your Job: 15 Working Days to Notify, 30 Days to Find Work (2026).
Here is the order we'd work through a freeze:
- Find out which test failed. Read the ZUS letter or the message in your eZUS account.
- Work test: ask your employer to confirm in writing that you're registered for pension and disability insurance and that contributions are paid.
- Residence test: collect proof of return, meaning boarding passes, tickets and passport stamps for every trip.
- School test: get a confirmation of enrolment and attendance from the school, preschool or learning institution.
- Send everything to ZUS in a written reply, keep copies, and note the date you sent it.
Practical tip: Every time you travel, keep your boarding passes and your child's school confirmation in one folder. If ZUS freezes the benefit over a Border Guard record, you'll have your answer ready in an hour instead of hunting for papers for weeks.
Does a social security agreement change anything for my country?
There is a carve-out. The work condition isn't applied to foreigners claiming the benefit when it falls under a bilateral social-security agreement that binds Poland. But don't assume your country is on that list. Before you decide you're exempt, ask us or ZUS, and until then file as if all three tests apply to you.
On timing: applications for the new benefit period opened on 1 February, and filing by 30 June gave back-pay from the start of the period. That date has passed. So file as soon as your three tests are in order, and check on zus.pl from which month payment starts for your filing date.
