What does the USC actually require from a foreigner?

Under the Polish civil status law (Prawo o aktach stanu cywilnego), a couple submits a written application to the registry office. A foreigner is expected to show a document confirming that, under the law that applies to them, they are free to marry. In practice, an office will usually ask for a set like this. Exact lists differ between offices, so treat it as a map, not a promise:

Your future spouse brings their own set. If your partner is Polish, that's the usual ID plus civil status papers. If your partner is also from Ukraine, both of you go through the foreigner's route.

Why is the certificate of legal capacity such a problem for Ukrainians?

For many nationalities, the home-country consulate issues a certificate that you can marry. For Ukrainians, Polish legal sources report that the Ukrainian authorities stopped issuing this document years ago, and consulates no longer fill the gap. That's why the standard route here is the court. The usual shape of the court route:

  1. A motion is filed to the district court (sąd rejonowy) in the non-litigious procedure, asking to exempt you from presenting the certificate.
  2. The court typically sets a hearing and listens to the applicant in person.
  3. When the decision becomes final (prawomocne), you take it to the USC together with the other documents.

Apostille, sworn translation and the paper trail

Ukrainian civil status documents are in Ukrainian or Russian, so a sworn translation into Polish is needed. Not a friend's translation, not an online translator: a Polish sworn translator, with the stamp and a register number. The couple chooses and pays for the translator.

Whether a document also needs an apostille or other legalisation depends on the document and on the office's practice. Some offices are relaxed, some ask for more. That's why it's smart to ask the specific USC before you spend money on stamps. And one more thing: names. If your name is spelled one way in the Ukrainian passport and another way in an old certificate, fix it before filing. A mismatch of one letter can freeze a file for weeks.

If you're not fluent in Polish, you'll also need an interpreter at the ceremony. The law lets the couple choose the interpreter, and the couple pays.

The one-month wait: can it be shortened?

Poland has a built-in pause: a marriage can't be concluded before one month has passed from the moment the couple submitted the written statements to the USC. A shorter date is possible only with a reasoned request to the registry office director, and it's granted for important reasons, not because the hall is already booked. Ukrainian status in 2026: UKR, CUKR and marriage

If you came after February 2022 and hold UKR status, note the dates. According to the Ministry of Family, the special act expired on 5 March 2026, but the legality of stay for people under temporary protection was extended to 4 March 2027.
