Getting Married in Poland as a Foreigner: USC Documents and the 1-Month Wait (2026)

Getting Married in Poland as a Foreigner: 2026 Guide

Getting married in Poland as a foreigner: the documents the USC requires, the certificate of legal capacity, the 1-month wait and what it means for karta pobytu.

You've picked a date, your family has already started asking about flights, and you walk into the Urząd Stanu Cywilnego (USC, the Polish civil registry office) to ask what to bring. The clerk lists it calmly: a certificate from your home country, a birth certificate, sworn translations. The passport in your bag is not enough. You leave with a list and one question: how do you get a certificate from another country when you've lived in Poland for years? Getting married in Poland as a foreigner is very doable, but the law really does ask for several documents, not one. Here is which ones, in what order, and what a marriage does and does not change for your karta pobytu.

What documents does the USC actually require?

Short answer: a passport alone is not enough. The requirements for foreigners come from Polish law, the Prawo o aktach stanu cywilnego (civil status records act) and the Kodeks rodzinny i opiekuńczy (family and guardianship code). The USC where you file confirms the exact list, and details can differ a little between cities.

General information on marrying a foreigner in Poland is on the government portal powroty.gov.pl, and answers on foreigners' rights are on gov.pl/web/cudzoziemcy. Here is the honest angle: the law requires several documents, and that is exactly where couples get stuck. You only need to give us your passport details — we collect and prepare the rest. More on that below.

What if your country will not issue the certificate of legal capacity?

For citizens of Belarus, Polish sources say the certificate is issued by the civil registry or the police authority at the person's place of residence. Documents from Belarus usually need an apostille (Belarus is a party to the 1961 Hague Convention) and then a sworn Polish translation. Order matters: apostille first, then translation of the document together with the apostille and stamps. Ask your USC exactly what it will require, ideally in writing, rather than guessing.

Now the awkward part. Polish lawyers report that in recent years getting this certificate through the Belarusian embassy or consulate can be practically impossible. If that is your situation, the law gives you a fallback: a foreigner can apply to the district court (sąd rejonowy) where they live for an exemption from the duty to submit the certificate. The court decides in non-contentious proceedings, and the ground is that obtaining the document meets obstacles that are hard to overcome. You have to describe them. According to court information, the fee for this application is PLN 100, but check the current amount with your court. Once the ruling is final, you bring a certified copy to the USC instead of the certificate. How long it takes depends on the court, so we won't promise a timeline.

An illustrative example (not a real client): Sergei, a long-haul driver from Grodno, and his girlfriend decided to marry in Poland. They could not get the certificate from Belarus, so they went through the court: described the reasons, attached evidence, waited for the ruling, then did the translations and filed at the USC. It took longer than they planned, but the file was complete and the USC did not send it back.

Why is there a one-month wait, and can it be shortened?

Under the family code, a marriage before the USC head cannot be concluded sooner than one month after the couple files the written statement (zapewnienie). It is time to check for obstacles. The head of the USC can shorten it, but only for important reasons. Pregnancy is the one most often cited, especially when the due date falls close to the wedding date. You file a written request with your reasons, the USC decides, and it is never automatic.

The practical point is that the month starts from the statement, not from your first visit. If the certificate or the court ruling is not ready, the whole chain shifts. A typical order looks like this.

  1. Visit the USC and get a written list of documents for your couple.
  2. Obtain the certificate of legal capacity, or go to court for the exemption.
  3. Get apostilles where needed and sworn Polish translations of every foreign document.
  4. File the written statement (zapewnienie) at the USC together with the full set.
  5. Wait out the month, or the decision to shorten it if you have grounds.
  6. Attend the ceremony. The stamp duty for drawing up the marriage record is PLN 84; confirm the current rate with your USC.
  7. Receive the Polish marriage certificate, the odpis aktu małżeństwa, the final document you will need later.
The ceremony at the USC takes minutes; the preparation takes weeks

Practical tip: don't book a venue, flights or guests until the USC has confirmed in writing that your set of documents is complete. The month runs from filing, and the certificate or court ruling usually takes longer to collect than people expect.

What does marriage change for your karta pobytu, and what does it not?

Marriage is a family event, not a route to residence. The authorities check whether a marriage is genuine: a real relationship, documented and recognised by Polish law. A marriage concluded only to obtain a permit leads to refusal and legal consequences. We only help real couples.

If your spouse is a Polish citizen, you gain a ground to apply for temporary residence as a family member. According to MOS (Moduł Obsługi Spraw), you will need:

What marriage does not do: it does not give you a card automatically, it does not extend an expired stay, and it does not remove the check on the relationship. If you marry a foreigner who holds a residence permit, there is a separate family route with its own conditions, and you need to check it against your situation. And if you are already waiting for a decision on another case, do not drop it before you have a result on the new basis. This is a moment to talk to a person rather than guess.

How does Legal Solutions help with marriage registration?

We organise the official registration of marriage at a Polish civil registry office (USC) for foreigners, ending with a Polish marriage certificate (odpis aktu małżeństwa). To start, we only need your passport details. We then prepare the documents, obtain the required certificates and zaświadczenia, arrange the translations, organise the procedure and accompany the couple at every stage. If the certificate from your country cannot be obtained, we explain how the court route works and prepare you for it. We are not a law firm of advocates and we do not represent you in court: our role is preparation and support. Frequently Asked Questions

Can I get married in Poland if my consulate won't issue the certificate of legal capacity?

Yes, through the court. A foreigner applies to the district court where they live for an exemption from submitting the certificate and describes the obstacles. When the ruling is final, you bring a certified copy to the USC. The court decides, not the USC, so the outcome and timeline cannot be promised in advance.

Do we have to wait a month if we're in a hurry?

The month is the general rule. Only the head of the USC can shorten it, and only for important reasons, such as pregnancy. You file a written request with your reasons. A wish to marry sooner, or tickets you have already bought, are not usually treated as sufficient.

Does marrying a Polish citizen give me a karta pobytu automatically?

No. Marriage gives you a ground to apply for temporary residence, but the voivodeship office decides after checking the documents and whether the relationship is genuine. You file through MOS no later than your last day of legal stay. A marriage concluded only to obtain a permit leads to refusal.

Do I need a sworn translator if the USC staff understand my language?

Yes. Foreign documents must be translated into Polish by a sworn translator (tłumacz przysięgły) from the Ministry of Justice list. Informal translations, and notarised translations made in another country, are usually not accepted. Check your USC's requirements before you order a translation.
