Awizo Missed Letter Poland: 14 Days Fiction of Delivery

Missed an awizo in Poland? After 14 days the urząd letter counts as delivered. Learn the 14-day appeal clock and what to do now. WhatsApp us for help.

It's Tuesday evening. You're emptying your bag after a night shift in Wrocław and you find a small notice slip from Poczta Polska. A registered letter is waiting for you at the post office. The slip is nine days old. You think: probably an advert. But the sender is the voivodeship office, and your Karta Pobytu (Polish residence permit) case is still open. Here is the uncomfortable truth about a missed awizo in Poland: you don't have to read the letter for the law to say you received it. After 14 days it counts as delivered, and every deadline inside it starts running without you. Let's walk through how this works and what you can still do.

What is awizo, and why does Poland treat a missed letter as delivered?

Awizo is the notice a postman leaves when nobody takes an official registered letter at the door. The Code of Administrative Procedure (Kodeks postępowania administracyjnego, art. 44) calls the next step 'substitute delivery'. In everyday language people say 'fiction of delivery'. The law pretends you received the letter, because otherwise anyone could freeze a case forever by simply never collecting their mail.

This is the usual timeline when the letter is sent by post:

  1. Day 1: the postman cannot hand over the letter and leaves the first notice in your mailbox (or on your door). The letter is kept for you for 14 days.
  2. If you haven't collected it within 7 days, a second notice is left.
  3. On the last day of the 14-day period the letter is treated as delivered, even if it is still sitting at the post office.
  4. The post sends the letter back to the office. The clock for your answer or appeal is already running, and nobody calls you to say so.

Official background on dealing with Polish offices as a foreigner is collected at gov.pl/web/cudzoziemcy. The delivery rules themselves sit in the Code of Administrative Procedure, which every voivodeship office (urząd wojewódzki) applies.

How many days do you have once the letter counts as delivered?

Delivery by fiction is not the end of the story. It is the starting gun. What is written inside the letter decides your deadline, so you need to know which kind of letter you missed.

We explained the first case in detail in Wezwanie Letter from the Urząd: 7 Days to Answer — What It Means, and the second in Karta Pobytu Refused? What to Do: 14 Days to Appeal. Read the one that matches your letter.

Do the maths early. Say the first notice was left at the start of the month. Fourteen days later the letter counts as delivered. Fourteen more days and the appeal window closes. That is roughly four weeks from the first slip, and a week of it disappears if you find the slip late. Counting rules are technical (the day of delivery itself is not counted), so never plan to file on the last day.

Here is a composite example, an illustration and not a real client. Bishal, a warehouse worker from Pokhara living in Łódź, missed two notices because the mailbox still carried the previous tenant's name. The decision arrived by fiction. When Bishal finally walked into the post office, only three days of the appeal window were left. They gathered the documents that same night and filed on time, so the case stayed alive. Most people in this situation lose the time before they ever open the letter.

Practical tip: the day you find any awizo from an urząd, photograph both sides of the slip, write the date in your phone, and collect the letter within 24 hours. The post office holds it only for the 14-day window.

Already missed it? What to do in the first 24 hours

Don't panic, and don't hide. Ignoring the problem is the one thing that makes it worse, because the deadlines keep running either way.

  1. Go to the post office named on the slip with your passport or residence card and ask whether the letter is still there. If the 14 days have not passed, you can still collect it in person.
  2. If it has already gone back, contact the office that sent it. Ask for a copy of the letter and the date of the awizo. Also check your MOS account and your e-Doręczenia mailbox, if you have them.
  3. Write down three dates: the first notice, the second notice, and the day the letter counts as delivered.
  4. Read the letter for the deadline (7 days, 14 days, or a fixed date) and count backwards from the day of delivery.
  5. Answer or appeal inside the deadline, even if your documents are not perfect. A short reply on time is better than a complete one that is late.
  6. Send us photos of the notice and the letter on WhatsApp. We'll tell you what your clock looks like and what to prepare.
Keep a simple paper or phone note of three dates: first notice, second notice, deemed delivery. Every later deadline hangs on them.

Can a missed deadline be restored, and when is the delivery itself wrong?

There are two separate questions here. The first is restoration of the deadline (przywrócenie terminu, art. 58 of the Code). If you missed a deadline without your fault, you can ask the office to restore it. You must show that it was not your fault, file the request within 7 days from the day the reason ended, and at the same time do the thing you missed, for example file the appeal. Serious illness, a hospital stay, or an emergency abroad with proof are the kind of reasons offices look at. 'I didn't check my mailbox' or 'I was at work' usually do not work. The office decides, and nobody can promise you the result.

The second question is whether the delivery was done correctly at all. Delivery by fiction only works if the post followed the procedure: two notices, left in the right place, at the right address. If the notice went to an old address, be careful. Article 41 of the Code says that if you did not tell the office about your new address, a letter sent to the old one is still effective. So a mistake by the post can sometimes be challenged, while a missed address update usually cannot. Have a specialist look at your papers before you decide which case you are in.

How do you make sure an awizo never catches you again?

Most of these cases are not about bad luck. They are about a mailbox, an address and a habit. Fix those three and you're safe.

Frequently asked questions

If I never saw the notice slip, is the letter still delivered?

Usually yes, if the postman left the notices properly at your address. The law looks at what the post did, not at what you saw. If the slip was left at the wrong address or only once, delivery may be defective, so keep any evidence and ask a specialist to check.

Does the 14 days start when I pick up the letter or when the awizo was left?

The 14-day storage period starts from the first notice. If you never collect, the letter counts as delivered at the end of that period. If you collect earlier, the day you receive it is the delivery day. Either way, your reply or appeal deadline starts from delivery, not from when you finally read it.

Can I still pick up the letter after it counts as delivered?

Only if the post office still has it. Even then the clock does not restart. If the letter has gone back, ask the office for a copy and the awizo date straight away and work from those dates.

I was in Nepal for a month. Can I get my deadline restored?

Possibly, but it depends on proof that it was not your fault, for example a medical emergency with documents. A planned trip is difficult to defend, especially when a case is open. The request has a 7-day limit from when the reason ended, so ask for help at once.

Does a missed awizo mean my Karta Pobytu will be refused?

Not automatically. What matters is what the letter asked for and whether you answered in time. If it was a request to complete your file and you stay silent, the office can leave your application without consideration. If you act inside the deadline, the case continues.
