Marrying a Foreigner in Poland: USC Documents 2026

Marrying a foreigner in Poland: which USC documents are required? Legal capacity certificate, translations, 1-month wait and the court route. Send us the passport.

You met in Poland. His visa has expired, there's a stamp in his passport from the karta pobytu application, and at the registry office (USC) you hear: "We need a certificate from his country saying he's free to marry." He can't travel home, because he might not be allowed back. The consulate says it doesn't issue such papers, or asks him to wait for months. So you start wondering whether marrying a foreigner in Poland is even possible. It is. Here's which documents the USC asks for, what can legally be replaced, and where we step in.

Which documents does the USC require from a foreigner?

Let's be honest first: a passport alone is not enough. Polish civil status law requires several documents from the foreign partner. The good news is that you, as the Polish partner, don't have to chase them yourself.

The basic list under Article 79 of the Civil Status Records Act (check details on gov.pl and with your local USC):

  1. an identity document – the foreigner's passport,
  2. a birth certificate, with a sworn translation into Polish,
  3. a document confirming that under the law of his or her country the person can marry (the certificate of legal capacity to marry),
  4. a written statement that neither of you knows of any obstacle to the marriage – signed by both of you at the USC.

On top of that come the Polish partner's documents (ID, birth certificate, proof that any earlier marriage ended) and a stamp duty. Some offices quote PLN 84 for drawing up the marriage record – confirm the amount with your USC. If the foreigner doesn't speak Polish, the statements are made in the presence of an interpreter.

Every foreign-language document needs a sworn translation. Documents submitted to the USC should also be recent – offices generally don't accept papers older than six months before the planned wedding date. So don't collect everything a year ahead "just in case".

Why is the certificate of legal capacity the real roadblock?

Two of the foreigner's three documents are easy: he has a passport, and a birth certificate can usually be re-issued. The problem is the certificate from his country. In many states there is simply no such document. A consulate says: "We don't issue that." Others issue it after weeks or demand a personal visit.

And he often can't go. He's waiting for a karta pobytu decision, holds a stamp in his passport, and the visa is long gone. Leaving may endanger his return. It's a loop: the USC wants a paper that nobody will give.

Marta from Gdańsk and her fiancé from Nepal were stuck like this for four months (illustrative, generalised example). The consulate wouldn't issue the certificate, the USC required it, and he was waiting for his card. A court application solved it – and they married without him leaving Poland.

The consulate says no – what then? The court route

The law has a way out. If a foreigner cannot obtain the required document and getting it meets hard-to-overcome obstacles, the district court (sąd rejonowy) may exempt him from presenting it. The application is filed with the district court and the fixed court fee is PLN 100. The court's decision then replaces the missing certificate at the USC.

We described how this works here: certificate of legal capacity when the consulate won't issue it and in the article on marrying a foreigner waiting for a karta pobytu.

What does the court need? Usually an application with reasons, evidence that the consulate doesn't issue the document (or that getting it is realistically impossible), both partners' details and proof of payment. The court assesses whether the obstacles are truly hard to overcome, so a well-prepared application matters. We can't promise how long the court takes – it depends on the court.

How long is the wait at the USC, and can it be shortened?

A civil wedding at the USC can take place at the earliest one month after you submit the statement about no obstacles. That comes from the Family and Guardianship Code. In justified cases the head of the USC may agree to a shorter period – but that's discretionary, not a right, and never guaranteed. So don't book the hall and the party for "surely two weeks from now".

Practical approach: submit a complete file as early as possible and fix the wedding date only after the USC accepts your documents. The office can ask for corrections – another translation, an extra paper, an explanation of spelling differences in names. Each fix costs days or weeks.

What does marriage change for a karta pobytu – and what doesn't it?

Let's say it plainly: marriage is not a shortcut to residence. Voivodeship offices and the USC check whether the marriage is genuine – shared life, relationship, evidence. A marriage concluded only to obtain a permit ends in refusal, and can bring legal consequences for those involved. We only help real couples.

A registered marriage can be the basis for a residence permit application on family grounds – but that is a new application with its own documents, fee and assessment. It does not automatically replace an earlier case and guarantees no decision. If your husband is waiting for a card on another basis (work, study), it needs thinking through how the marriage affects that case.

Practical tip: before ordering translations, ask your USC for its list of documents for foreigners and whether it accepts a court decision instead of the certificate. You'll avoid paying twice.

How we help – just send the passport details to start

Legal Solutions organizes the official registration of a marriage at a Polish civil registry office for foreigners, ending with a Polish marriage certificate (odpis aktu małżeństwa). To begin, we only need your partner's passport details. We prepare the rest: we assemble the documents, obtain the required certificates, order translations, run the procedure (including the court step if the consulate won't issue the paper) and accompany you at every stage.

The law requires several documents – the passport is only the start. The difference is that we collect them, not you running between consulates. We don't promise timelines or outcomes: the USC decides on the wedding, the voivodeship office on any residence application.

Frequently asked questions

Is a passport enough to marry a foreigner in Poland?

No. Besides ID, the USC requires a birth certificate with a sworn translation, a document on the right to marry under his home law (or a court decision exempting him from presenting it), and a joint statement of no obstacles. With us, the passport is enough to start – we prepare the rest.

His visa expired and he's waiting for a karta pobytu – can we still marry?

Usually yes, if the file is complete. If the consulate won't issue the certificate and he can't travel, the district court can exempt him from presenting it (fee PLN 100). This is the most common route in such situations.

Will he get a karta pobytu automatically after the wedding?

No. Marriage gives no automatic residence. You must file a separate application on family grounds, and the office checks whether the relationship is genuine. A marriage made only for a permit ends in refusal.

Can the one-month wait be shortened?

The standard wait is one month from the statement. In justified cases the head of the USC may allow a shorter period, but it's their discretion and you can't count on it in advance.
