Priya and Arjun got married in Kerala in March. Nice ceremony, a proper certificate with stamps. Now Arjun lives in Warsaw, his employer asks for "the Polish marriage document", and Priya wants to join him. Someone in a WhatsApp group says, "Just do transcription." Another says, "No, you must marry again in Poland." Who is right? Both can be, depending on who you are. This guide explains how to register a marriage certificate in Poland, what the Polish civil registry office (Urząd Stanu Cywilnego, USC) really asks for, and what the paper does and does not change for your karta pobytu (Polish residence permit).
Married abroad: which of the three situations are you in?
Polish law does not treat every marriage the same, so first find your case. Case one: you married abroad, and one spouse is a Polish citizen. Then a foreign certificate can be moved into the Polish register by transcription. Case two: you married abroad and both of you are foreigners. Transcription is mainly a tool for events that concern Polish citizens, so ask the USC what it will accept; usually you work with the original foreign certificate, a legalisation or apostille where required, and a sworn translation. Case three: you have not married yet and want a Polish ceremony at a USC, ending with a Polish marriage certificate (odpis aktu małżeństwa).

What is transcription, and who can actually use it?
Transcription (transkrypcja) means a faithful, literal copy of a foreign civil status document into the Polish civil status register. The clerk does not correct spellings of names. If the foreign certificate says "Mohamed", the Polish record says "Mohamed", even if your passport differs.
Under the Polish civil status law, the application can be filed by a person the event concerns, or by someone with a legal interest. It is obligatory in practice for a Polish citizen who needs a Polish ID or PESEL, or who wants other civil status acts done in Poland. The official consulate pages describe it as a transcription of the foreign certificate, with a stamp duty of PLN 50 — see gov.pl on transcription of a foreign marriage certificate and the powroty.gov.pl guide. Check the current fee with your USC before paying.
What you bring is simple on paper: the original foreign marriage certificate, usually with an apostille or legalisation depending on the country, and a translation by a Polish sworn translator. The office may refuse if the document looks doubtful or the marriage would be against Polish public order. That is why a clean, correctly translated file matters more than speed.
Marrying in Poland instead: what does the USC ask from a foreigner?
If you have not married yet, the Polish route is a real legal procedure, not a formality. The law requires several documents from a foreigner. Nobody can honestly say that a passport alone is enough.
- An identity document (passport), with a sworn translation into Polish.
- A birth certificate extract, usually translated by a sworn translator.
- If previously married: a marriage certificate with a note on divorce, annulment or the spouse's death.
- A certificate of legal capacity to marry from the authority of your country, or from your embassy or consulate in Poland, stating you can marry under your national law — also translated.
- If your country will not issue that certificate: a district court decision exempting you from the duty. Courts grant it in specific situations, not automatically.
If you do not speak Polish, a sworn translator must be present at the procedure and at the ceremony.

How long is the waiting period before the wedding?
A marriage can be concluded after one month from the day you submit the documents, and the documents stay usable for a limited time (the practical window is six months). In important situations the head of the USC may shorten the month. Not every office does, and not every reason is accepted — so we never promise a date. Plan backwards: certificate of legal capacity first (it can take weeks in some countries), sworn translations second, USC submission third. Ask in advance how long the foreign certificate stays valid at your USC, because some offices accept it only for a few months.
Will they check if the marriage is genuine?
Yes. Offices and the voivodeship, which later look at a residence application, pay attention to whether a marriage is real. A marriage concluded only to obtain a residence permit does not give a safe path: it leads to refusal and can bring legal consequences. We say this plainly because it protects you. Legal Solutions helps only real couples who live, or plan to live, together.
Here is a composite example, not a real client. Maria, a nurse from the Philippines, and her fiancé, a Polish citizen, wanted to marry in Warsaw. Her consulate was slow with the capacity certificate. They gathered everything in the right order, submitted at the USC, waited the month and married. Afterwards she applied for a residence permit as the spouse of a Polish citizen with the Polish certificate in hand.
Practical tip: before you pay any translator, ask your USC for the exact list of documents and the allowed age of each one. Translating a certificate that is too old means paying twice.
What does a registered marriage change for your karta pobytu?
This is where people expect too much. A Polish marriage certificate proves you are married. It does not give you a residence permit by itself.
- Spouse of a Polish citizen: you can apply for a temporary residence permit as a spouse, usually granted up to 3 years, with later renewals possible.
- After a marriage lasting at least 3 years, and two years of continuous stay on a spouse-based temporary permit, a permanent residence permit becomes possible.
- Spouse of a foreigner with a work-based card: the route depends on the permit of your spouse and the family rules; marriage alone does not change your own work permit.
- Spouse of an EU citizen: separate EU family rules apply.
