Wedding first, residence card second: how does the order work?
There are two stages. First, you marry at a civil registry office (Urząd Stanu Cywilnego, USC) and receive a Polish marriage certificate (odpis aktu małżeństwa). Second, the foreign spouse applies for a temporary residence permit for family reunification, filed only online through the MOS system. The official page is MOS – spouse of a Polish citizen. It applies to spouses from countries outside the EU.
The key rule: the application must be filed no later than the last day of the husband's legal stay in Poland. A wedding doesn't extend a visa or a visa-free stay. If the application is filed on time and any formal defects are corrected within the deadline, the stay is legal from the filing date until the decision becomes final. Marrying a foreigner at a USC: which documents are needed and how long is the wait?
You'll read online that a passport is enough. It isn't. The law requires several documents from the foreign partner, and the exact list depends on the country and your situation. Most commonly:
- valid passport or other ID for both partners,
- a document confirming that under the law of the foreigner's country they can marry (a certificate of legal capacity to marry) — or, if the country doesn't issue one, a court ruling that replaces it,
- civil status records if either of you was married before (previous marriage certificate plus a divorce judgment or death certificate),
- sworn translations of foreign-language documents, and often an apostille or legalisation,
- written statements, made at the USC, that nothing legally prevents the marriage.
The certificate from the husband's country usually has limited validity, so its date matters. Don't order it months in advance. Then there's time: a marriage before a USC head cannot be concluded earlier than one month after the statements are submitted. The head of the USC can shorten that period, but only for important reasons and on a justified request. Never count on it in advance.

What does the marriage certificate change for a karta pobytu, and what doesn't it change?
The certificate gives you grounds to apply. It doesn't give you a card automatically. Many couples learn that too late. What does change:
- the temporary residence permit for the spouse of a Polish citizen is granted for up to 3 years,
- the state fee is PLN 340 for the permit plus PLN 100 for issuing the card,
- a spouse who has received this permit can work in Poland without a separate work permit,
- for this type of permit you aren't required to show a stable income, health insurance or confirmed accommodation.
And what doesn't change. The wedding doesn't extend legal stay on its own. It doesn't give citizenship. It doesn't stop the office from checking whether the marriage is genuine. And it doesn't guarantee an outcome or a decision date. Re-check every amount and document list on the MOS site on the day you file, because requirements get updated.

What can the Polish spouse do? A checklist
Formally the foreign spouse files the application. In practice a lot depends on you, because the office is judging a relationship between two people. Work through these in order:
- Write down the date his legal stay ends and set a reminder weeks ahead. That date is your hard limit.
- Set up access to MOS. Login goes through login.gov.pl, so test it early.
- Order the marriage certificate. For the application it should be issued no earlier than 3 months before you file.
- Prepare your own ID. The office may ask for your documents as the Polish spouse, so check the current list in MOS.
- Collect proof of shared life: a joint address or lease, utility bills, dated photos from different months, travel tickets, messages, joint financial documents.
- Be ready for questions. The office may send a summons, check the address, or question each of you separately.
- Answer every letter within the deadline stated in it. A missed deadline is the easiest way to turn a simple case into a hard one.
Practical tip: Start one folder (paper and digital) for proof of shared life from the wedding day, not from the day the office asks. Dated photos, joint bills and tickets spread over several months work better than one written statement.
Does the office check whether the marriage is genuine? Yes, and there are no shortcuts
Let's be direct: marriage is not a shortcut to residence in Poland. The office assesses whether the marriage is real. The Act on Foreigners allows refusal of a permit when the marriage was concluded to circumvent the rules (art. 100 sec. 1 pt 6). A marriage concluded only to get a permit leads to refusal, and people who help arrange it can face legal consequences. We only help real couples.

And after three years? Permanent residence for the spouse of a Polish citizen
The temporary permit isn't the end of the road. A foreigner can apply for permanent residence if they've lived in Poland continuously for at least 2 years on a temporary permit granted because of the marriage to a Polish citizen, and at least 3 years have passed since the wedding (art. 195 of the Act on Foreigners). Absences are allowed within limits: no more than 6 months in a single period and no more than 10 months in total.
The permanent residence application is also filed only through MOS, no later than the last day of legal stay. So keep a calendar from day one: wedding date, decision date, card expiry, and dates of longer trips abroad.
