Receiving a refusal decision (decyzja odmowna) on your Karta Pobytu application is frightening. But it is not the end. In Poland, you have the right to appeal — and with proper legal support, the majority of refusals are successfully reversed.
Why Applications Get Refused
- Missing or incomplete documents
- Income below the required threshold at the time of application
- Errors in the application form
- Invalid or expired documents at time of submission
- Address not matching PESEL registration
- Employer's documents were incomplete
- Previous visa violations on record
What Happens When You Get Refused
The Voivode sends you a written refusal with specific reasons (uzasadnienie). This document is critical — it tells you exactly what went wrong and on what legal basis. You have 14 days from the date of delivery to file an appeal (odwolanie).
The Appeal Process
- Read the refusal carefully — identify every reason listed
- Prepare counter-arguments and gather supporting documents
- Write a formal appeal (odwolanie) addressed to the Szef Urzedu do Spraw Cudzoziemcow (Head of the Office for Foreigners)
- Submit via MOS or in person within 14 days
- The second-instance authority reviews your case — decision within 2 months
If the Appeal Is Also Denied
If the second-instance authority confirms the refusal, you can take the case to the Administrative Court (Wojewodzki Sad Administracyjny). This is a formal legal proceeding and requires a lawyer. Success rates in court are lower, but it is still an option.
During the Appeal — Are You Legal?
Yes. If you submitted your appeal within 14 days, your legal stay is maintained during the appeal process. Your current stamp or visa remains valid. Do not leave Poland during this time.
Common Mistakes in Appeals
- Submitting the appeal without addressing all refusal reasons
- Missing the 14-day deadline
- Not attaching new supporting documents
- Submitting only an emotional letter instead of legal arguments
